Supreme Court Allows Transfer of Jose Padilla

The Supreme Court ruled today in a one page order (pdf) that the Government may move Jose Padilla from military custody to the civilian custody and bring him to Miami to stand trial on terrorism charges.

The defense alleged the Government's planned move was an attempt to avoid a ruling on the underlying issues in Padilla's habeas case.

Padilla's lawyers don't see this as a total loss.

Donna Newman, told The Associated Press today that she was pleased at the Supreme Court's statement in its one-page order that the broader issues in the case would be weighed "in due course."

    In the previous reality this would be a good thing because no citizen should be held w/o due process. But since 'in due course' has no relation to 'a speedy trial' I remain sceptical of their motives.

    This is an outrageous decision clearly about political propaganda and nothing to do with what justices are supposed to stand for. It certainly lowers America's credibility and destroys the constitution further. To see the Supreme Court endorsing such a role is a shameful moment. US citizens should be extremely concerned over this case, it is their rights that are going down the drain. Good luck for the future...
