Jose Padilla Denied Bail, Pleads Not Guilty

Jose Padilla was denied bail in Florida today and pleaded not guilty to the charges against him.

In denying bail, U.S. Magistrate Judge Barry Garber sided with prosecutors who said Padilla likely would flee to avoid trial and that the charges - including allegations that he attended an al-Qaida training camp in Afghanistan - made him dangerous.

Miami lawyer David Markus was there and has a recap of the hearing.

    Guess what, BB? If I were in Padilla's situation and they allowed me bail I'd be outta town and vanished so fast you'd think I had a car waiting outside the courthouse just on the outside chance. So would you. Guess we both deserve Gitmo, huh?

    edger.. Guess we both deserve Gitmo, huh? Well..not unless we cook up a plot to kill people...then yes... I think we would. charliedontunderstand... Who said he should be set free, clueless? Yes..many "clueless" people here (just like yourself) have said time & again... charge them or set them free. as all the other rights he's entitled to as a US Citizen, Yes...and that includes firing squad if he's found guilty...yes? Dismissed & expelled

    BB, The complaint people have with the handling of Padilla has to do with the fact that he is an American citizen who was held in legal limbo as an enemy combatant for more than three years. He was denied due process.

    Do not get into an argument with BB, he does not have the intellectual acuity to give an informed argument.

    If he is guilty, I surely don't want him to be set free. The thing is he has to be set free if the Constitution is worth something more than the hemp paper it is printed on. Understand the difference BB? Some things are more important than some accused two-bit terrorist. Way more important. One of these days I'll get you to see it my way brother. Some may call my view "america-hating", but in reality it is out of love for America and the wish to see America protected from those who attempt, with or without malice, to destroy it from within. In this case, those that want to weaken the rights of due process for American citizens.

    Well..not unless we cook up a plot to kill people...then yes... I think we would. And if we allegedly cook up a plan? Still think we would deserve Gitmo? With no charges filed? No opportunity to protest your innocence? No right to defend yourself? No access to your laywers? Probable torture? Damn right I'd run if granted bail. So would anyone... And the fact that he was denied bailed is not a conviction of any crime, by any stretch of the imagination. "Innocent till proven guilty", only when it suits BushCo? This guy is an American Citizen. He deserves the same "right" to his "rights" as any other American Citizen. If his rights are thrown out so are the rights of all other American Citizens. But these days I guess "American Citizen" doesn't mean much, does it?

    Not anymore. It is perfectly fine, and consistent with due process, when a JUDGE decided that he is a flight risks and should not be allowed to post bail.
    I am not arguing that Padilla being denied bail is inconsistent with due process! But for the 3 years that he was held as an enemy combatant denied Padilla of his right, as a US citizen, to due process!

This 'two bit' terrorists as you put it could have (would have) killed a few hundred people had he been able to carry it out. As far as I'm concerned...our laws are not meant to protect scum like him. He should be shot & I hope he is in the end. Edger.. But these days I guess "American Citizen" doesn't mean much, does it? No..I guess not. As I said in another post..... As long as citizens can sneak in under the fence....it has kinda lost it's meaning.

    Then let's see the evidence. Present it at trial and let a jury of his peers convict him. Remember, this is an American citizen we are talking about. The say-so of the criminal executive branch is not enough to prove Padilla or anyone guilty in my eyes. I prefer evidence. All you or I know for sure is that Padilla has been accused of planning a bombing of some kind, and has been held in a cage for 3 years without charge. our laws are not meant to protect scum like him

    Oops posted to soon. You are wrong on that last point. Our laws are meant to protect all American citizens...even scum or alleged scum.
