Some things not worth their own post:

Stephen Miller is the latest to follow a string of White House staff getting COVID-19. (His wife had been with Mike Pence, prepping him for the debate but she left when she got the news about her husband. She had the virus in May).

Kellyanne Conway, aka Ms. Most Unimportant Person in the World, is still fighting with daughter Claudia over Claudia's airing of the family's dirty laundry on TikTok. Claudia says her mom gave the virus to her. And in one TikTok, now deleted, you can hear Kellyanne screaming at Claudia and using the F word. I guess this is what goes for "more mama less drama" in the Conway household. At the Rose Garden ceremony, there were serveral photos of Kellyanne and Bill Barr, standing shoulder to shoulder, laughing and talking spiritedly, with their mouths just inches away from each other and neither wore a mask.

There's a debate tonight between Kamala Harris and Mike Pence. I haven't decided whether to watch yet. I might choose to re-watch some episodes of Money Heist (casa de papel) or the 4th season of Reign, or the 4th episode of Tehran. I hate when streaming services release one episode a week. Don't they know we're all binge-watchers? Also good: Trackers (South African) and Departures. So many movies with bad CIA characters these days. [More...]

I could use a good new narco-drama to get me through election day without paying attention to Donald Trump, but I don't think there are any on the horizon. At least there's a new season of the Great British Bake-Off and although co-host Sandi is gone, the wonderful Noel is still around. The show is also being dripped to us at one episode a week. But as of now, there are four you can watch in one sitting.

Last item: James Corden interviewed Hillary by video the day after the debate (Bill popped in for a minute). She was on for at least three segments. It was refreshing to hear her rational, calm answers. James Corden is now in his sixth season, and he's as funny as ever. He's the only person who can make me laugh out loud when I'm home alone. I wish I could put him in my back pocket as I'm driving around during the day. He'd be so much better than the car radio.

    that I would much rather hear both of them answer the question that they have been asked? So far, I have not heard a single instance of that from either vice presidential candidate. I guess my hopes were baseless that someone running for high national office might possibly be direct and honest, and not a bullsh*tter. So sad.

    is as bad as Wallace.  Pence answers his question he wants not the one asked.  No push back other than thank you's.  Kamala is handling it well as did Biden with Trump.  

    Most people do not know much about Pence other than being Trump's fourth wife.  This event may open more eyes to the reason he is such a toady---they are peas in a fetid pod. We all need a shower after this one.  Debates with hypocrites, liars, and miscreants is like debating with alien lizards.

    in high school and had a debate scholarship in college.  I would much rather see a format similar to what I did in high school.

    There is basically a single topic which in this case could be modified for each debater.  Pence would be given the topic of "Resolved the Republicans should be elected" and given the affirmative side or Harris would be given the topic "resolved the Democrats should be elected" and given the affirmative side.  

    Times could be adjusted but the affirmative goes first for say ten minutes, then the negative gets five minutes of cross questioning, then the negative gets ten minutes and the affirmative gets five minutes of cross questioning.  Rinse and repeat this.  Then switch to negative getting a ten minute rebuttal (in formal debate called the negative block) and the affirmative getting the final ten minute rebuttal.

    This roughly mirrors how debates are held in both high school and college.  As for maintaining time limits there is a timer set for five or ten minutes at which point a bell starts ringing literally drowning out the debaters.

    No need to worry about bias in the moderator asking or leaking questions or any other bias.

    Truth be told I would much rather see Harris and Pence making their case; and even more so cross questioning each other, especially about how they both evaded answers in the actual debate.

    over to Senator Harris reveals a red left eye-- that may be an early symptom of COVID infection.  Those plexiglass screens are inadequate.  If held at all, this should have been by remote.  Pence, apparently, was instructed to interrupt--still believing it to be an effective tactic, that and Pence's piety and lies..

    Pence was taunting her, in his milquetoast way, by repeatedly interrupting her and taking her time.

    And the moderator, who only tonight is revealed as having hosted a pro-Pence party, enabled him all the way.

    With those odds, Kamala handled herself -- and him -- well.

    But really, with moderators like Wallace and Page, the Commission on Presidential Debates is done. Cn we please bring back the League of Women Voters as Moderators? They would not have allowed the constant flouting of the rules by Trump and Pence. And Leaguers get questions answered.

    Seemed to adopt a debating tactic of being aggressive without being abrasive.  She made points in demonstrating Trump/Pence ineptness and cruelty.  But, the drawback was that this tactic did not prepare for Pence's skill at the-re-direction of questions.  The moderator was the perfect foil to facilitate that tactic.

    Pence's problem was he was boring and sickly looking and is probably ill. And, he showed that he is Trump without the warmth and beautiful hair.  He was easily eclipsed by the fly.

     Senator Harris gave confidence that she was well-equipped by experience and temperament to be president,  if necessary.

    "The Commerce Township worker pulled over to remove two political signs that were 9 feet within the road right-of-way...     When I addressed the people of Michigan on Thursday to comment on the unprecedented terrorism, conspiracy and weapons charges against 13 men, some of whom were preparing to kidnap and possibly kill me, I said, "Hatred, bigotry and violence have no place in the great state of Michigan." I meant it. But just moments later, President Trump's campaign adviser, Jason Miller, appeared on national television accusing me of fostering hatred.

    I'm not going to waste my time arguing with the president. But I will always hold him accountable. Because when our leaders speak, their words carry weight.

    When our leaders encourage domestic terrorists, they legitimize their actions. When they stoke and contribute to hate speech, they are complicit. And when a sitting president stands on a national stage refusing to condemn white supremacists and hate groups, as President Trump did when he told the Proud Boys to "stand back and stand by" during the first presidential debate, he is complicit. Hate groups heard the president's words not as a rebuke, but as a rallying cry. As a call to action.

    Whitey Ford, the Yankees' Hall of Fame left-hander who was celebrated as the Chairman of the Board for his stylish pitching and big-game brilliance on the ball clubs that dominated baseball in the 1950s and early '60s, has died. He was 91.

    Pitching for 11 pennant-winners and six World Series champions, Ford won 236 games, the most of any Yankee, and had a career winning percentage of .690, the best among pitchers with 200 or more victories in the 20th century.

    One of my childhood heroes.

    Joe Morgan, the Hall of Fame second baseman who became the sparkplug of the Big Red Machine and the prototype for baseball's artificial turf era, has died. He was 77.

    Morgan's death marked the latest among major league greats this year: Whitey Ford, Bob Gibson, Lou Brock, Tom Seaver and Al Kaline.

    reported gingerly, but expressively, the religious communitarian cult that appears to be an integral part of Judge Cony Barrett'a life.  The People of Praise is a small, "especially insular" group whose members are, primarily, very conservative Catholic. It is a movement that began with a "bolt from God". The spiritual fervor involves speaking in tongues--religious ecstasy utterances that may be incomprehensible (e.g. babbling) spoken through the deity.

    The group's beliefs, include a strict view of human sexuality that embraces traditional gender norms and rejects openly gay men and women.  A strong emphasis is placed on differences between the sexes. Men and women are designed by God for different purposes.  A husband's responsibilities include "correcting" his wife should she stray from the proper path.

    Group members are "heavily involved in one another's lives. The term handmaiden is used for female leaders (Amy is listed in the directory as as such for South Bend).  Those who are single often live with married couples and families where tasks are shared. Guidance from leaders is given to singles on dating. A young doctor was advised not to prescribe contraceptives; he later left the group as he found the rigidity was not good for his emotional health. And, too, he found his politics becoming more progressive.

    A former member claimed the closeness is amazing and was "extremely suffocating." Another former member said the "community is more important than anything else in your life.  It's a whole different level than being a member of a church."

    Judge Cony Barrett's father, a lawyer for Shell Oil, was a leader in a Christian community that became People of Praise.  The young Amy was embedded in the community and went to Notre Dame Law, the group's national hub. She married Jesse Barrett, who himself had been raised in South Bend's People of Praise community.

    Scrutiny of Judge Cony Barrett's communitarian religious cult will be sensitive in hearings, but it needs to be done. The focus should be, primarily, from the point of view of her life's influence on her role as an Associate Justice. It is not a matter of her Catholic religion, but of warily inquiring about the potential impingement of this insular movement upon the laws of the land.

    of religious freedom in the Constitution is not the Religion Clauses of the First Amendment, it is the clause of Article VI, para. 3, which states that "no religious Test shall ever be required as a Qualification to any Office or public Trust under the United States." Being a member of a certain religious group (any group) or holding certain beliefs (or not holding such beliefs) is not and cannot be a criterion for putting someone on the Court, or for keeping them off the Court. The question(s) to Judge Barrett must be framed in terms of her understanding and appreciation of the relationship between her religious beliefs and her public duties. Republican Senators should be placed in a position to acknowledge that the same rule applies to putting a religious Muslim, or an atheist, or an Orthodox Jew on the Court, as to a Charismatic Catholic.

    at Judge Barrett's words.  In 2006, she gave a commencement speech to law graduates of Notre Dame, in which she exhorted them to make their legal careers a means to an end---and "that end is building the Kingdom of God."

     Subsequent concerns expressed about that speech were defended as having nothing to do with building a theocracy or proselitizing--just that ND graduates are special; and these words were a benign urging to bring their religious faith into the public sphere.

    However, Judge Barrett, as a former Scalia clerk and Scalia "texualist", should be aware that a temporal understanding, especially for a diverse country, may construe her call to graduates as an urging to join a theocratic political project.

     A thought not inconceivable given the insular perspectives of her life-long religious communitarianism and the likely permanent minority views of her extremist political conservatism needing a theocracy so as to stay in power.

    In this context, her claims to "apply the law as written" give rise to serious questions. For example, any judgment based on Constitutional principle may not be a law as written--the Kingdom of God may not find privacy in the 14th Amendment, but could find hand guns (which did not exist at the time) in the 2nd Amendment. A law as written, could be blatantly unconstitutional.

    And, too, it might be questioned if it is the Supreme Court's role is to "apply" the law, rather than interpreting the law so that lower courts know how to apply the law.

    written, Captain, Joe, Kamala and other Democrats, with strategic wisdom, have not allowed themselves to answer repeated questions regarding the idea of expanding the membership of the Supreme Court.  

      The backing off of FDR's proposal to add Justices, apparently a political necessity at the time, did put the fear of the Lord into Justices.previously hell bent on over-turning  the New Deal.  
    The Biden "no comment", in a creative fashion may have a similar effect without election-time risk.

    However, Court expansion, both the number of Supreme Court Justices and the number of Circuit Courts is an idea whose time has come as a result of judicial and political necessity.  

    In a comment in a previous thread I presented arguments for such expansion, including Court packing by Republicans, the additional states admitted to the Union and the population increase since setting the present number of Supreme Court Justices in 1869. And, the legal and social complexities associated with such changes.  Moscow Mitch, essentially, reduced the number of SC justices to eight for a year, by refusing to even interview Judge Merrick Garland.  

    While, I believe, a persuasive case can be made for Court reform, Constitutional protection of Americans will wind up happening by blunt political effort.  But, then, Constitutional checks and balances on the Courts have been entrusted to the Congress---a political body.

    it would be better if Biden were to say, more or less, "There are serious, sensible people in my Party urging that response to the Republicans' dishonest tactics in packing the courts, not just the Supreme Court but also the lower federal courts, with extremists, in the hope that those judges will assist them in preserving their undemocratic, minority control of our government. Others in my Party, whom I respect equally, are putting forward good arguments against it. When and if the time comes, I will listen thoughtfully to both sides and try to make the best decision I can."

    not "textualist." Textualism is the Scalia-ites' methodology for reading and applying statutes (which does not always produce reactionary results, as we see from the LGBTQ Title VII cases this spring ("Bostock")). "Originalism" is their theory for interpreting the Constitution, which is what underlies "Citizens United" (supposedly).

    Here's another way to (try to) think about it.   Democrats  cant stop this.  I mean maybe there will be some Coronavirus level intervention from god but otherwise they probably can't stop it.

    But she is a walking excuse to expand the court.  We are a diverse country.  They shouldn't be all anything.  Personally I include Christian.  

    She should not be excluded because of her beliefs and the court should be diverse enough there can be a handmaiden without disastrous results.  

    She can't be the deciding vote.  That should be the argument.

    this is a serious problem for Coney Barrett since a news item just popped up on my phone where she is literally swearing that she will follow the law not the dictates of People of Praise. After Brett Kavanaugh lied over and over in his hearings we should question whether any federalist society member won't do the same thing.

    Joni Ernst is now asking that the judiciary committee members all take COVID tests. This whole thing has become some sort of rolling disaster for the GOP.

    I think might be important.  And that the left might be mostly unaware of if they don't surf the crazy wave occasionally.  Trump supporters do not think he is losing.  They don't believe the fake news polls.  They have polls of their own.  This is something I have really noticed in checking the crazies FB posts.  They really don't think he is losing.

    Or that he is going to lose.  I saw polls that gave Trump a 99% chance of winning.

    I don't know what this means for us after Nov 3rd.  But it seems likely Trump supporters like Russia are spreading this stuff in the hope of causing as much chaos and possible.  

    I think it will work.  20-30% of the country is going to believe the election was stolen.  

    I hope the FBI and others are as worried about this as I am.

Could you see a few of the president's congressional sycophants go over the cliff with him? Sure. But the overwhelming majority of Republicans, confronted with the reality of a landslide defeat in the Electoral College, will realize that it's time to see Trump out--and time to look ahead to 2024.

    I think it's pretty special.  Raise your hand if you expected chubby unassuming Aunt Hippolyta  to be the time traveling superhero.

    Also the fact they made both Hippolyta and Ruby, um, large women.  Ruby mostly.  Ruby is large and in charge and she has a steaming hot role.  Very unusual for a tv drama.   Maybe a chubby star but not the repeated steamy as heck beautifully shot S€X scenes.  With a man who is really a white woman.  

    Also the last episode included the funeral of Emmett Till.  And made you feel you were there.  But the scene where the woman mentioned above with Ruby, after being told she can't imagine how they feel about Emmett, pays two rednecks to kill her, she can return, exactly the way Emmett Till was murdered.

    I confess I did not know the details.  But you should give a google and read about it.   And this is shot close up and personal.  They beat her, a lot, shoot her, twice, tie her to a heavy object with barbed wire around her neck and drop her in the river.

    One of the most horrific things I ever saw.  And as you are watching you realize it is harder for you to watch because they are doing it to a beautiful well dressed white lady.

    Pretty good stuff.  EMMYs are in its future I think.

    But I think a big enough win would make all that follows safer.  Because the outcome would be more predictable.  

      No doubt he will do whatever.   Multiple people have warned about bombing some unfortunate country.  I was just watching a discussion of the possibility he would prophylacticly (word?) pardon himself.  As Ford did with Nixon.  No matter what I did I pardon myself.  

    Who doubts he would try that.  And apparently it would be a legal question if he could do it.  What do you think?  They made a pretty good case.  At least good enough the courts may get have to decide.

    But the bigger the loss the better.  I also think, I think I said this before, that the country and the world would be better off if he completely loses it after losing.  There are people who literally think the guy is some kind of savior.  More of them than you or I would like to believe.     The Senate Judiciary Committee plans to issue a subpoena to Twitter Chief Executive Jack Dorsey after the social-media company blocked a pair of New York Post articles that made new allegations about Joe Biden, which his campaign has denied, the Wall Street Journal reports.

    "The subpoena would require the Twitter executive to testify on Oct. 23 before the committee, according to the Republicans who announced the hearing. Republicans are singling out Twitter because it blocked a pair of stories the Post said were based on email exchanges with Hunter Biden, the Democratic candidate's son, that were provided by allies of President Trump."

    ABC's townhall ask Biden about the NY Post story or try and sweep it under the rug.  I would bet dollars to donuts the NBC townhall with Trump will play it up bigtime.

    Also have to wonder about the flack NBC got about going head to head with ABC; not much question about which show will get the higher ratings.

    Had an interesting talk with my brother in law yesterday.   For him social media is coffee at the River Bend Cafe.  He was clearly really shocked when I showed him some of his grandsons FB posts.  I have described them here before.

    He is what you might call a DixieCrat Curmudgeon.  Mad as hell that republicans have taken over the state and also that they are tearing down confederate monuments.

    But he is not a bad person really.  And he was, I hate to use the term, troubled.   We agreed dangerous times ahead.  And that people we knew have become people we don't recognize.
