Attacking Judges

The right wing's misguided war against judges is disturbing to those who believe that an independent judiciary is necessary to protect the public from abuses of power in the other branches of government. The war against judges, fueled by the hate-mongering rhetoric of the right, is also disturbing to judges. One who has good reason to be disturbed: Joan Lefkow, whose husband and mother were killed by a disgruntled litigant "whose decade-long legal crusade against doctors, lawyers and the government was dismissed by the judge last year."

Judge Lefkow knows too well that those who demonize judges are creating a climate that will lead to more tragedy.

The judge ... said recent attacks on the judiciary by the televangelist Pat Robertson and by some members of Congress fostered disrespect for judges that "can only encourage those who are on the edge or on the fringe to exact revenge on a judge who displeases them."

"I have come to know scores of judges during my 22 years as a magistrate judge, bankruptcy judge and district judge. Whether a liberal or conservative, I have never encountered a judge in the federal judiciary who can remotely be described as posing a threat as Mr. Robertson said, 'probably more serious than a few bearded terrorists who fly into buildings.'"

When Tom DeLay predicts retribution against judges who didn't intervene in Terri Schiavo's case, when John Cornyn purports to understand the frustration that leads to courthouse killings of judges he deems "unaccountable" to the public (the "public" consisting of right-wing extremists), sitting judges have reason to fear that the elected representatives who pander to extremists are inviting -- even inciting -- further violence.

Indeed, federal marshals were on duty at a Chicago restaurant where Judge Lefkow was eating on Friday night when someone taped a profane, derogatory note to the window. The note did not specifically name Judge Lefkow, but the authorities said it was probably intended for her.

    ...so when can we start taping notes to the restaurants frequented by Limbaugh, Coulter, Savage, Medved, Hannity, O'Rielly? When the rules of law aren't followed, only outlaws will make the rules. Harvey is already in a knife-wielding stance, and asks that they first work out the rules: "No, no, not yet, not until me and Harvey get the rules straightened out." As Harvey rises up and exclaims: "Rules - in a knife fight? No rules!" Butch swiftly kicks him in his crotch with a perfectly-aimed blow. The uprising is quickly suppressed as Harvey crumples to his knees and grabs his groin. Butch mocks his opponent: "Well if there ain't gonna be any rules, let's get the fight started. Someone count 'one-two-three-go'."

    Butch Cassidy & SD Kid. Why can't judges be criticized for poor decisions if you think their decisions are poor or wrong or you just don't like them. Bart Ross was a nut, he wasn't motivated by Pat Robertson. Owens and Brown are receiving severe criticism for their decisions, much of it personal. I believe Brown, if I recall correctly, wants to take us back to pre-Civil War days. Bork to an era of rogue police officers busting down doors for no good reason.

    Ed, Why should judges be criticized for decisions? Why should we want to live in a free country? Who, in your opinion, in our supposedly free nation, should be above criticism? And Priscilla Owen, to name one of these jurists, has received not qualified ratings from her peers.

    Ed, I just re-read your post, and realized I didn't get your focus the first time. The comment about Owen stands, however.
