Judge Rejects Ashcroft Argument On Rules During National Emergency

JURIST's Paper Chase, a blog written by law students, has a heavily hyperlink annotated posting last night: Judge rejects Aschroft's claim that appeal rules are not applicable in emergencies. The government detained two Muslim men in the wake of 9/11, held them in solitary confinement, and then deported them, denying them all access to the courts while in the U.S. The court ruled that they could sue, rejecting former AG Ashcroft's defense that the rules just don't apply during national emergencies.

    Hey Ronnie, as much as you might not like it, here in free America everybody gets there day in court. Even brown people from foreign lands. Do you really want to leave it up to the whim of corrupt govt. officials what rules must be followed and when? Bottom line, I don't trust them, and neither should you. If the two men in question committed a crime or entered the country illegally, it shouldn't be too hard to prove it at a hearing and then deport them. What is it about tyranny you find so appealing?

    The government detained two Muslim men in the wake of 9/11, Yes...exactly what I expect my Government to do to protect my ass ... and then deported them, denying them all access to the courts while in the U.S. Why do so many on the left feel every single person on earth is entitled to access to "american" courts? The court ruled that they could sue.. Yes... welcome to America..the most lawyer friendly... sue happy nation on earth! Too bad I'm not from another country... knowing what I know...all I'd have to do is get in the US... get arrested and be set for life! I think the libs should have to pony up the lawyers fees for all these poor misguided put out displaced individuals so the rest of us don't have to.

    The point is not that they were detained - the point is that they had no process at any point. They were held in solitary confinement for months on minor criminal charges. They had their faces slammed into walls. One of these gentlement had a flashlight inserted into his anus and saw it covered in blood when it was removed. They were not allowed to have any phone calls or in person contact w/ lawyer or family. The MDC even lied to their lawyers when they tried to see their clients and said they weren't kept there.     The rules are there for a reason, fellas. I expect govt. to follow them.

    Yep, they are gone...with enlarged, bleeding rectums thanks to people who think like you. Tonight I will drink to a dream of a torture free America with due process for all.

    While the judge might not have ruled on their claims, the Bush Administration's own DOJ Office of the Inspector General (Glenn Fine) has, and has substantiated virtually every single claim the plaintiffs in both cases have made. They can be found here and here.
