Autopsy: Mass. Gay Bar Shooter Killed Self in Ark.

The alleged shooter in the gay bar shooting in Massachusetts who allegedly shot and killed a 63 year old police officer in Arkansas during his flight, previously reported here, was found to have shot himself, according to an Arkansas State Crime Laboratory autopsy result released by the local prosecutor.

    Whether it was suicide by cop, or suicide at his own hand, it was a suicide.

    This is such a nerd question and will prove that I'm a 1L in law school, but what is the protocol for using "allegedly" after the "alleged" criminal is dead? I see where you wrote "the alleged shooter" but I'm pretty sure I read a report yesterday that said that ballistics tests show that the bullets and gun that killed Robida were the same bullets and gun used in the gay bar attack. Even though he never had a trial, should he still be called "the alleged" attacker, shooter, whatever? Ten years down the road, with evidence like the ballistics to show Robida's guilt, should we still say "alleged"? Is there a standard protocol for that, or is that something that one has to use his/her own judgment for? Please, lawyers or law students only for this response. I know what the reactionary answer is, and what many of you think the answer SHOULD be, and that's great and all, but that's not what I'm looking for.

    Nice troll response Narius. He asked an honest question, no need to bludgeon him with your opinion.

    Wow, I'm so glad I asked for lawyers and law students only to answer my question, since I knew people like narius would say exactly that without regard to my actual legal question. And for further info, my question extends to the protocol for ALL similar cases, not just whether this one particular guy should be an "alleged" killer or not.

    rojo, "Alleged" would be proper in court, but in regular speech, at this point, I think that it can be dropped. The public shootout kind of ended any potential prejudice at trial.
