Ken Lay Autopsy Report Released

The Pitkin County (Aspen) Sheriff's office has released Ken Lay's autopsy report (pdf). The Sheriff's office states in its press release:

On July 19th 2006 The Pitkin County Sheriff's Office received the full autopsy results of Mr. Kenneth Lay from Dr. Robert Kurtzman. The manner of death has not changed, and is classified as natural. The immediate cause of death was classified as arteriosclerotic cardio vascular disease. Based on these findings this case is now closed, there is no evidence of any criminal activity. The post mortem report is available on www.aspenpitkin.com.

Shorter version: Lay had clogged arteries. The Aspen Daily News reports:

At the time of his heart attack - his third - Lay had severe
three-vessel coronary artery disease, with more than 75 percent blockage in three arteries, according to the autopsy report prepared by Dr. Robert A. Kurtzman of Grand Junction.

....Prior to the heart attack, Mr. Lay had woken up at about 1 a.m., and had a brief talk with his wife Linda before going to the bathroom. Lay's wife discovered him in an unresponsive state on the floor in the bathroom after she heard a "thump," the report says.

"He had vomited and had brief seizure like-activity. 911 was called and life support initiated and continued until the arrival of EMS. The decedent was transported to Aspen Valley Hospital where he was reported dead," the report says. "Prior to his collapse the decedent did not report any chest pains, nausea or shortness of breath, but had recently been experiencing upper gastrointestinal symptoms for which he was taking medication."

Will this put the conspiracy theorists to bed?

Joe DiSalvo, chief of investigations for the sheriff's office, said Wednesday that the department has been bombarded with calls from people about Lay's death.
DiSalvo said a reporter from Alaska called Kurtzman about Lay's death, challenging him to take a lie detector test to prove that he had actually seen Lay's body. DiSalvo said he hopes the release of the autopsy puts the rumors to rest, but he didn't appeared convinced that it would.

Lay was cremated, said DiSalvo, adding that he does not know where the remains are.

If they didn't want conspiracy theories, they would have put his bloated corpse in a gold frame and on the front page of my newspaper.

Were they able to determine whether or not he actually HAD a heart? And, if so, was it three sizes too small? He was a grinch after all.

Let me ask you one question. Is your money that good? Will it buy you forgiveness? Do you think that it could? I think you will find when your death takes it's toll all the money you made will never buy back your soul. Dylan Masters of War

When he had a heart attack, why did the family call the sheriff's office? Is this sheriff's office friendly with Dick Cheney, kinda like the boys in Texas who don't ask no questions when ya shoot a man in the face?

Around here, we just call 911. The dispatcher sends whoever is appropriate. Inside the city limits, it's the local police. Outside, in unincorporated areas, it's the Sheriff's Office. Kurtzman is an excellent forensic pathologist. He's the Mesa County coroner. He was brought in because of his credentials; Aspen is in Pitkin county. Don't look for conspiracy theories here. If Kurtzman says he's dead, he's dead :)

Here's one of my favorite DiSalvo quotes
"It think if someone wanted to fire a cannon on their own property, I think they could do that," said Pitkin County sheriff's investigator Joe DiSalvo. "I think by statute it would be OK." Link here

I have some sympathy for Ken Lay. He started with next to nothing and built a massive corporation out of almost nothing. When he initially retired and handed control over to Skilling, Enron wasn't engaged in any of the fraud that brought on its collapse. Lay only got in trouble years later, after Jeff Skilling abruptly stepped down. He came back to the company as Skilling's replacement and presided over Enron's last six months. During that time, I'm sure there were warning signs. But I don't think anyone gave Ken Lay a welcome back powerpoint presentation on the elaborate accounting fraud orchestrated in his absence. I'm not saying that Ken Lay wasn't complicit in the fraud for those last 6 months. He had an unquestionable obligation to publically disclose the fraud as soon as he knew about it. But if he had done that (which would have been the right thing to do), it would have bankrupted the company, wiped out all of the employees' and investors' stock, and probably wiped out hundreds of millions of his own wealth too. So even though I can't condone his actions, I have at least a little sympathy for the guy. He lacked the fortitude to do the right thing, but I'm not sure he was the black-hearted crook and monster that he'll be remembered as. All that said, I never followed the Enron story closely, so if I'm way off base here I certainly don't mind being corrected.

Yeah...so instead of going public with the massive fraud he got his hundreds of millions out and left the employees and investors holding the bag. Real stand-up guy. I'm afraid I don't share your sympathy. Ken Lay and his cohorts are the poster-boys for greed and unregulated capitalism, imo.
