       Using his "originalist" philosophy, Scalia said he likely would have dissented from the historic 1954 Brown v. Board of Education decision that declared school segregation illegal and struck down the system of "separate but equal" public schools. He said that decision, which overturned earlier precedent, was designed to provide an approach the majority liked better.

        "I will stipulate that it will," Scalia said. But he said that doesn't make it right. "Kings can do some stuff, some good stuff, that a democratic society could never do," he continued.

        "Hitler developed a wonderful automobile," Scalia said. "What does that prove?"

    Stephen Breyer, sparing us the trouble of a comeback, notes that while flogging may have been legal in the 18th century, our standards of "cruel and unusual punishment" have drifted as well.

    There was a Seinfeld episode about this; Elaine gets someone who speaks the same language as the women at her nail salon (Korean, but most of the ones I go to are 100% Vietnamese), and discovers that, indeed, they are mocking her mercilessly.

    Personally, I don't care as long as they do a good job, and I always tip them excessively.

    Among them, he forbade the Hispanic workers at the run-down, Southwestern adobe-style hotel from speaking Spanish in his presence (he thought they'd be talking about him), and ordered some to Anglicize their names.

    No more Martin (Mahr-TEEN). It was plain-old Martin. No more Marcos. Now it would be Mark.

    in my neighborhood shopping center is owned by a Vietnamese woman, who calls herself "Nancy."  Each of the women working for her has an "American" name.  She gives them the evil eye when they speak Vietnamese to each other.  Most of these women's English is not the best.  (I do often wonder if they are laughing at the customers!)  But, no, I don't care if they speak Vietnamese.

    but judging from the linked doc its probably doesn't translate well...good stuff.

    Segues well into this...it does seem the guy is trying to align with racial resentment in the area..."the asians are taking over" nonsense is as old as me in Flushing.  Kim could be as shady as a...well, NYC Councilman for all I know, but you can say that without playing Bocci.

    has been cancelled tonight due to rain.  I get in trouble around here calling it Halloween....which cracks me up, and then when I've upset Conservative Christians I can never change my vocabulary after that. They have several jumparoo things they put on the front lawn, and every ticket sold this year counts because the school district is broke.  So we will do it next week.  But I had all the face paints out last night before we got the phone call that it was no go.  Face paints were out, daughter was laying back on the couch with an aching back, my second grandchild is threatening to not even show up for a Halloween party or a Fall Festival.....I needed to paint my frustrations out.

    And it is named after Saints.  So, thusfar it is viewed as a very good holiday to celebrate around here BUT.....it is a rememberance of Saints.....which is one of those things brought in by the idol worshipping papists.  All of our Holidays are only steps away from being very evil.  There is an aroma of Jesus that wafts off of Valentine's Day though when you remember that is named for Saints so we focus on loving each other and sniffing for the waft.

    I celebrate both Halloween and Dia de Los Muertos.

    Day of the Dead (Dia de los Muertos) celebrations take place over several weeks, although the holiday is traditionally celebrated between October 31st and November 2nd. Families remember deceased loved ones and honor them by building offering altars (ofrendas) where sugar skulls are placed, along with offerings of pan de muertos. The holiday is festive although the content may not be, as spirits are welcomed back into peoples' lives for another year.

    You can find me this Sunday at the Muertos Y Marigold parade.

    Are you serious that people have a problem with Halloween by you?  It's a holiday as American as apple pie...or so I thought.  Can't wait for the Haloween parade this year since its on Saturday...they go all out in the Village...its quite a sight to behold.

    Halloween was my mother's fave holiday though.  She was a nut about it, so don't think that you six homeroom moms can give me the Southern frowny face everytime I say Halloween and think that it will mean squat to me.  Also, isn't celebrating the seasons Pagan.....but shhhhhhhh......let's not get that started or the whole state will split between the Blood of the Lambs (sounds Pagan too) and those who will refuse to give up their celebrations.  So we'll keep the frowny faces thing going....which is supposed to mean but can't possibly rationally mean that we are respectfully Christian around here.

    but where I live that is just me.  And I'm not going to change, but many of the military families that blow in and out of here make an effort to just go with the local flow.  Well that is how the flow stays exactly how it is.  I still celebrate Halloween.

    I miss having lines of costumed kids coming to my door for candy. Most of these "pagan" holidays were already removed from the schools by the 90s when my kids were there. Thank goodness the stores still decorate and celebrate :)

    there are fewer and fewer kids out trick-or-treating every year as well as some schools rejecting this fine holiday...since I'm often not home I leave a basket of goodies on the step...the last few years the thing is still half-full when I finally make it home.

    My nieces will be out, and I'll probably join 'em before the parade...its a great tradition.

    And the Buddhist upped my ante on the Holiday.  There is a blogger named Sallycat who wrote about the pagan celebration rituals for Halloween and Christmas, and it seemed like such a refreshing way to cherish certain very real aspects of living and life....so for the past three years I have added a few pagan rituals to our family celebration of both holidays.

    At the Buddhist temple I attend, we have the Segaki Festival (feeding the hungry ghosts) this Sunday. It is not strictly halloween, but it does make me think that many cultures/religions have some sort of event this time of year that has something to do with ghosts/spirits.

    My time in Catholic school meant observing the holy day called All Saints Day on Nov. 1, followed on Nov. 2 by All Souls Day. That was a favorite because everytime one said the prayer combo of a Hail Mary, a Glory Be and an Our Father, another soul was released from purgatory and sent to heaven. The goal, as we schoolchildren understood it, was to send as many souls as possible to heaven, so that a mighty chorus of souls beholden to you was in place in heaven to ease your own way to eternal salvation. A satisfying, if self-serving, holy day.

    Is optimistic about reform.  Or at least about the political aftermath.  Not sure people here will agree, considering the conversations had about the MA plan.  He does have a point about public opinion levels.  Although I wonder what the support levels were like before the plan was implemented, since I imagine they were fairly high.

    I think he makes a good case for a camel's nose as well.
