Roman Polanski Granted Bail

Director Roman Polanski has been granted bail in Switzerland.

German radio reported this morning (hat tip to reader Scribe for the translation:)

The film director Roman Polanski, incarcerated because of sexual misconduct, will be released from jail on bail. The Swiss federal court in Lausanne imposed a bail of about 3 million Euros. Polanski must turn over all passports and will be placed under house arrest. Additionally, the court may require him to wear an electronic ankle bracelet. The Swiss police had arrested the director at the end of September on an arrest warrant out of the USA. Polanski is alleged to have abused a 13 y/o girl in 1977 after giving her alcohol and drugs.

Polanski will remain in jail while the Swiss Justice Ministry decides whether to appeal. They have 10 days to make the decision.

1030 AM ET (430 PM German time) and the translation is from their 11 AM ET newscast.

Oc and I were going back and forth about it way down in the open thread. OC and I both like the German colloquialism in the headline from the story: "Polanski auf freiem Fuss". In German, "auf freiem Fuss" means you've been granted bail or are otherwise getting out of custody. The literal translation would be "on free feet" - a nice image IMHO.

That's the colloquial term for becoming eligible for bail or getting out of custody. I suppose since he won't be chained by the ankles in some dungeon or wearing leg irons, having an ankle bracelet would count.

Here is CA Penal Code section 2900.5
A prior version of this statute apparently specified home detention w/electronic monitoring qualified for credit for time served. But the statute sunsetted. Not sure if it was amended. Plus, Polanski's home stay w/electronic monitor is not in lieu of time spent in the County of L.A.'s custody.
But, hey, the breaks are falling Polanski's way this week. Sentencing judge in LA County Superior Court may be sympathetic.
