Portland DA: No Charges For Al Gore

The Multnomah County Oregon District Attorney's office says no charges will be filed against Al Gore as a result of the allegations of the masseuse who filed a complaint against him.

"Ms. Hagerty’s detailed statement however, is insufficient to support a criminal charge given other contradictory evidence, conflicting witness statements, credibility issues, lack of forensic evidence and denials by Mr. Gore."

DEFICIENCIES IN THE CASE:

1. Ms. Hagerty, who has red hair, states she called Mr. Gore immediately following the alleged incident and told him to “dream of redheaded women” seemingly in contradiction to her assertions that she was terrified of Mr. Gore. Two days after the alleged incident Ms. Hagerty also sent an email to the Hotel Lucia stating that she appreciated the business referrals she received from the hotel. She did not mention any problem with Mr. Gore;

2. Witnesses at the hotel where the alleged incident occurred state they do not remember seeing or hearing anything unusual---directly contradicting Ms. Hagerty’s published claim in the July 12, 2010 of the National Enquirer that she was “shaking and in shock” and “rushed down the hall and to the lobby where the front desk clerk noticed she was upset was asked if she was OK”;

3. Forensic testing of pants retained by Ms. Hagerty as possible evidence are negative for the presence of seminal fluid;

4. Ms. Hagerty has not provided as repeatedly requested medical records she claims are related to the case;

5. Ms. Hagerty has also failed to provide other records related to the case;

6. Ms. Hagerty failed a polygraph examination;

7. It appears Ms. Hagerty was paid by the National Enquirer for her story; and

8. Mr. Gore voluntarily met with detectives and denied all of the allegations.

    that the DA would release that memo.  I don't think I've ever seen anything of the kind before.  And gutsy of Gore (and his attorneys) to go against conventional wisdom in how he responded to the charges (see DA's point 8).

    of a coverup and this never goes away.  This way, the DA's office can move on to investigating and prosecuting real alleged crimes and not have to waste its time on false or fantasy allegations of crimes.  Plus, it trashes the accuser's story and credibility.

    All in all, this is bureaucratic efficiency in action.

    I am glad to see this report. It sounds as if this lady has a big problem and it isn't Mr. Gore.
    I am impressed with the speedy resolve of the accusations.

    ok, based on the review and conclusion of the da,
    I will agree that this woman's statement can't be trusted, and we are left with no really clear idea of what happened, other than that,

    things didn't happen as she said.

    Whether that means that Gore was a perfect gentleman, or, that Gore politely suggested sexual things, directly or indirectly, or, that they had sexual contact completely or somewhat consensually, and then, she decided to sue him for it--it would be hard for me to guess.  

    What seems to us to be the most reasonable alternative to her story?  Sexual conduct that she later thinks she could use to make some money?  Or, nothing but a bad/evil imagination

    Several years ago, there was a news article on a different subject . . .
    There was a male massage practitioner, and there was a woman who saw him and on one massage, there was or she alleged there was sexual touching, and she alleged she was upset about it

    and it turns out that part of the area of the massage establishment was videotaped.  There was not a videotape produced in the massage rooms,
    but in common areas where people are dressed and going in and out and waiting, if they wait
    and it turns out that there was a jar for tips, which was a different place than for the usual payment
    and in addition to his normal payment, she had tipped him.  I forget if it is a large tip, or if she did it with a smile or happiness, or both
    or neither, but the tip or its size or her expression or 2 of these things, destroyed the "case," against him.
