Applications Out Today for Young Immigrants to Defer Removal

Today is the day that hundreds of thousands of undocumented young persons who have been residing in this country can start applying for a two year period of protection from deportation.

Under President Obama's recent order, U.S. Citizenship and Immigration Services (USCIS) is handling the applications. The forms became available today.

Individuals requesting consideration of deferred action for childhood arrivals must submit Form I-821D, Consideration of Deferred Action for Childhood Arrivals, Form I-765, Application for Employment Authorization (with accompanying fees); and an I-765WS, Worksheet. USCIS recently developed a series of resources to inform the on how the process will work. The website, www.uscis.gov/childhoodarrivals, includes a flier, a How do I brochure, frequently asked questions, and a number of other resources. USCIS encourages individuals with questions to visit this website or call the USCIS National Customer Service line at 1-800-375-5283.

Deferred action is a discretionary determination to defer removal action of an individual as an act of prosecutorial discretion. Individuals who receive deferred action will not be placed into removal proceedings or removed from the United States for a specified period of time

    In the absence of a future path towards full legalization and with the coming elections with a potential for overturning Obama, doesn't it seem like we ask people to jump into the fire and pray?

    about it if I had no papers.  Even assuming Obama wins re-election, there are no promises beyond two years.  I wouldn't bet on a permanent Dream Act passing within 2 years, not with this dysfunctional congress.

    I hope those applying aren't just dropping a dime on themselves, with an ICE dispatch coming in two years.  otoh, 2 years without an axe hanging over your head is worth something when all that seperates you from being deported to a country you don't know is a traffic stop, depending on where in the country you call home.

    The deportations have not stopped. ICE hasn't stopped coming.

    A few weeks ago my extreamly republican CEO got a call from his very republican wife. She was with several other high school teachers (party affiliation unknown) who had just learned that one of their students was being deported.

    He told me about the call and said they expected him to do something about it. He said the kid was an honor student. I said Obama's stopped all that. There was an executive order a couple months back...

    They hired an immigration attorney to represent the young man who already had legal representation of some type.

    I asked him about it the other day. He said the kid is back in Mexico. They believe that there is a chance that they can get him back, but it's still a work in progress at this point.
