    Fortunately, or not, Greenwald captured the original, "Dr. King's Dream for the Global Strike Team," before anyone noticed.

    Was THE MAN in St. Louis.  He was enormously beloved, and he never lost the love of St. Louisans even after he retired.  If anything, their love for him continued to grow.

    He's honorable enough to stick it out for the next two years of that 4 year vacation he said Obama could take if filibuster reform didn't go through, but likely has no taste to go though a re-election campaign just to suffer through the second half of it.

    WASHINGTON (AP) -- In a setback for President Barack Obama, a federal appeals court ruled Friday that he violated the Constitution in making recess appointments last year, a decision that could severely curtail the president's ability to bypass the Senate to fill administration vacancies.

    The three-judge panel of the U.S. Court of Appeals for the D.C. Circuit said Obama did not have the power to make three recess appointments to the National Labor Relations Board because the Senate was officially in session -- and not in recess -- at the time. If the decision stands, it could invalidate hundreds of board decisions made over the past year.

    The court also ruled that the president could only make recess appointments if the openings arise when the Senate is in an official recess, which it defined as the once-a-year break between sessions of Congress.

    The ruling also threw into question the legitimacy of Obama's recess appointment of Richard Cordray to head the Consumer Financial Protection Bureau. Cordray's appointment, also made on Jan. 4, 2012, has been challenged in a separate case.

    If Obama's recess appointment of Cordray to the newly created consumer board is eventually ruled invalid, it could nullify all the regulations the consumer board has issued, many of which affect the mortgage business.

    were appointed by Republicans. Chief judge David Sentelle, for those who don't remember, was instrumental in getting Ken Starr appointed to replace Robert Fiske who the original special prosecutor in the Whitewater nonsense. Fiske was ousted because he could not find anything in Whitewater that justified continuing the investigation.

    IMO, any judicial decision with Sentelle's fingerprints on it lacks an credibility. As I said, he is a political hack in judicial robes.

    a Republican hack masquerading as a judge.   The North Carolinian is a protege of the late Jesse Helms and an ally of former hog farmer and one-term US Senator, Lauch Faircloth (perhaps,the best thing John Edwards ever did was to defeat Lauch).

     After a Capitol Hill lunch with Helms and Faircloth, Sentelle ousted Fiske and arranged for the appointment of Ken Starr, a Solicitor General under Daddy Bush.  Starr was appointed despite his Republican background and having assisted in the Paula Jones case against President Clinton.  Of course, Sentelle was gifted to us by Rehnquist so as to appoint the special prosecutor since Judge James MacKinnon had caused problems with his previous history of appointing Lawrence Walsh to investigate Iran-Contra--an entirely too robust investigation for Republican tastes.  But, Sentelle did what he could by voting to vacate the convictions of Oliver North and John Poindexter.

    of Oliver North and John Poindexter were legally correct.  Congress compelled them to testify about the crimes they committed in the Iran-Contra affair, overriding their Fifth Amendment privilege claims.  The special prosecutor failed to ensure that their immunized testimony would not be used indirectly against them before the grand jury and at trial, as required by the immunity statute (in order that it comply with the Fifth Amendment).  As a result their convictions were properly overturned.  The ACLU filed friend-of-the-Court briefs to support their positions on this. Even evil men who seek to subvert democratic government and then lie to Congress about it are entitled to have their Constitutional rights respected.

    And this is what is so hard for so many people to understand.  
    As Sir William Blackstone said,
    "better that ten guilty persons escape than that one innocent suffer"
    We cannot abrogate the Constitution for someone just because we think that they are evil.  If we do this today for someone who may indeed be a piece of sh!t, then tomorrow, the government may well come after you.

    referring to George MacKinnon.  The three-panel appellate judges in the North case were Sentelle, Silberman (majority, appointed by President Reagan) and Patricia Wald (appointed by President Carter), chief judge at the time of the DC Circuit, who dissented.

    Judge Sentelle has announced that he will take senior status as of his 70th birthday, Feb 12, 2013.  Judge Merrick Garland (appointed by President Clinton) is scheduled to become chief judge.  Four of the ll DC Circuit positions are now vacant, giving President Obama a chance to re-shape the long-standing Republican appointed majority thinking--if nominations are made and confirmed.

    that jbindc forgot to mention that above....that the 3-judge court was comprised of all conservative Republican appointees.  That must just be a coincidence :)

    As I recall, also: The "filibuster" agreement this week contains a specific provision said to speed up district court judicial appointments & sub-cabinet appointments (like NLRB?)

    You were able to read the whole article and find that out.

    What does it matter if it was by all Republican appointees?  It's still a judicial ruling that puts the certainity of certain appointments and promulgated regulations at risk.  At the very least, it makes it more certain that this will go to the Supreme Court.  Wanna take your chances with how Anthony Kennedy feels about it?

    in the first instance or rehearing en banc...we'll find out soon enough.  

    In any event, my "compliments" about the sleight of hand ...true, we could have looked separately (which some of us obviously did); and, yes, it was all Repubs.  That might not be a significant tidbit about politicization of the courts for you...for others, tho, it may be a factoid worth thinking about in days ahead.
