Anthony Wiener Pleads Guilty

Anthony Weiner pleaded guilty today to transferring obscene material to a minor.

DOJ's press release is here. He pleaded to an Information, before indictment. The parties estimate his guidelines to be 21 to 27 months. He gave up his right to appeal a sentence within that range.

He was released on bond pending sentencing. He also has to forfeit his iPhone.

    see why he needs to spend "years in prison".  Doesn't sound like he ever touched this girl or even met her in person?

    "years" in prison (2 years, that is), but trust me, if he had met (or tried to meet) the girl in person the probable sentence would have been more like 12 years, and if he had touched her, more like 20 years. You don't know federal sentencing in child sex cases. I have had clients sentenced to 12 years for downloading and looking at pictures (CP) with no communication with any actual child at all. This is not about what Wiener "needs"; it sounds to me like he is being treated better than almost anyone else I have heard of who engaged in similar conduct.

    but is automatic, if the relevant state statute applies by its terms. Not something the judge decides at sentencing, nor it is ordinarily negotiable as part of the plea agreement. I find it very unlikely to imagine that Wiener won't have to register.

    Is there any level 1, level 2 type of system?  Or does someone who sends inappropriate texts get labeled the same as a serial rapist?

    Pennsylvania, for example, has three "tiers" -- five years, ten years, and lifetime, IIRC. Or maybe it's ten years, twenty years, and lifetime.

    And they are worthless. Most I have seen do not differentiate from someone caught peeing in public to a real child molester. No difference between an 18 year with 17 year old girl/boyfriend who was persecuted by some overzealous prosecutor. They SO registers are wrong headed and worthless. They are a continuation of punishment after someone has served their time. They are perpetuation of that fact that this so-called christian nation is a full hypocrites who absolutely do not believe in forgiveness or redemption although their so-called "good book" tells them to.

    has listed a "Risk Assessment" for offenders in addition to their conviction(s) info.

    Looking at Van Nuys, CA, where I used to live, of the 67 listed, there is quite a range from:

    Risk Assessment of "-1"

    for a guy with one conviction for:
    "LEWD OR LASCIVIOUS ACTS WITH A CHILD UNDER 14 YEARS OF AGE"

    up to this guy with a Risk Assessment of "10"

    with four convictions of:
    "LEWD OR LASCIVIOUS ACTS WITH A CHILD UNDER 14 YEARS OF AGE"
    "INDECENT EXPOSURE WITH PRIOR CONVICTION FOR THIS OFFENSE"
    "ANNOY OR MOLEST CHILD UNDER 18 YEARS OF AGE"
    "INDECENT EXPOSURE"

    Almost all of the rest are in the 0-5 range, with the majority of those in the 0-2 range. Maybe one other "8" and a couple 4's and 5's.

    I'm not sure what you consider a "very low level offender," but I could find none on the SO registry for Van Nuys, anyway, that were in there for public urination or anything like that...

    Anthony Weiner's fetish issues have ultimately caused his wife nothing but grief, both personally and professionally. Best for Huma Abedin to simply make a clean break. It's truly a shame, because I think she really does love him. But that's pretty much a lost cause at this point, and she has to look out for both herself and her child.

    Speaking for myself only, I've always liked the guy and was really rooting for him to clean up his act. But that lack of self-control has ultimately rendered him a monumental waste of talent. I sincerely hope he finally gets the proper psychological help that he so obviously needs, so that he can henceforth live his life in peace and dignity without posing any further problem, either to himself or anyone else.
