Taylor Swift Victorious in Groping Trial, Her Mom and Bell Not Yet

Bump and Update: Taylor Swift emerged victorious yesterday when the Judge in her trial issued his order on the Rule 50 motion described below.

I received this email from Clerk of Court who sent it to everyone on the approved media list:

When the case goes to the jury on Monday; it will go forward on the tortious interference with contract claims against defendants Andrea Swift and Frank Bell; any damages for the plaintiff will be limited to plaintiff's 2-year employment contract; and the defendant's counterclaims will go forward. In other words, none of the claims against defendant, Taylor Swift, survived the defendant's Rule 50 motion.

Update: Team Swift is not calling any witnesses. (Translation: They didn't feel they needed any. I think they are right.) I'm glad they decided not to call the professor to expound on gender violence. The judge has their motion for judgment as to Taylor Swift (to drop her from the case) under advisement. He'll rule today. Closing arguments will be Monday.

So, what will the jury decide on Mueller's claims? They will obviously know she's been dismissed because they won't be asked to deliberate on her when deciding Mueller's claims. Her mother liable? And will they decide in her favor on her assault counter-claim? Will they give her $1.00 or more? What if Mueller is ordered to pay her legal fees?

David Mueller has rested in the Taylor Swift "groping" trial. The parties are back in court arguing standard motions made at the end of the Plaintiff's case. In this case it is Rule 50.

a) Judgment as a Matter of Law.

(1) In General. If a party has been fully heard on an issue during a jury trial and the court finds that a reasonable jury would not have a legally sufficient evidentiary basis to find for the party on that issue, the court may:

(A) resolve the issue against the party; and

(B) grant a motion for judgment as a matter of law against the party on a claim or defense that, under the controlling law, can be maintained or defeated only with a favorable finding on that issue.

If the motions are denied, it's Taylor Swift's turn to present her side of the case. Her lawyers have said they will call a "gender violence" expert and a forensic computer expert (who will try to debunk Mueller's assertions his computer data was rendered non-recoverable after his devices were damaged.)

Her then-bodyguard testified this morning.

    dismissing Mueller's case, with Swift's counter-suit against him to go to the jury. Can the jury award her more than the $1 she sued for, as a penalty against him for lying about what he did and trying to blame his (ex-)friend?

    He has left intact Ms. Swift's countersuit against him for assault and battery.

    This is likely going to turn out badly for David Mueller.

    judge: insufficient evidence that @taylorswift13 acted improperly. there are other named defendants.

    But for all intents and purposes, the bottom's dropped out of the plaintiff's case. Taylor Swift was the primary target, not Mom. If Swift prevails in her countersuit, the other two are likely off the hook as well.

    Dent (bodyguard) says he saw Mueller put his hand under Swift's skirt, Swift jumps and moves closer to Mueller's girlfriend

    Mueller's GF says, "I don't have eyes in the back of my head."

    Mueller's best friend says he had never known him to be disrespectful to a woman.

    Court is in recess for lunch until 1:15p Mountain Time.

    Mueller's lawyer rests case (plaintiff rests).

    Swift's lawyer moves for judgement to be made in case. Only evidence is @taylorswift13 reported incident to Mom&management -- no evidence she illegally interfered with Mueller employment.  Zero evidence that @taylorswift13 did not believe she wasn't inappropriately touched.

    Judge asks Mueller's lawyer why he didn't name 13 Management in lawsuit.

    Swift lawyer asks judge to release @taylorswift13 from this case. Judge breaks for recess to take request under advisement.

    Evidentiary part of trial is complete. Judge says closing arguments in this case will happen on Monday. Jury has been released until 9:30a Monday.

    Judge: Far too late for plaintiff to admit he named the wrong parties and filed the wrong claims. Mueller should have sued 13 Management.

    Judge: Court finds 2-year employment contract sufficient for damages.

    Judge: Both Andrea Swift and Bell acted intentionally to contact KYGO -- Taylor Swift didn't context KYGO directly.

    Judge: Sufficient evidence remains that could lead jury to believe that KYGO did not act independently but by request of Andrea Swift & Bell.

    Judge: Taylor Swift reportered alleged assault to mom and tour staff (not KYGO). Insufficient evidence that @taylorswift13 acted improperly.

    about paying opposing lawyers fees. i googled the issue and it seems to be rare and limited to certain 'nuisance' cases.

    can a jury decide to give more that the one-dollar amount requested? mueller is limited to recouping his losses from the two year contract.

    Will they give her $1.00 or more? What if Mueller is ordered to pay her legal fees?

    the judge gave specific instruction on monetary damages. the jury could awarded taylor 1-dollar (or not) and Mueller any amount up the his actual financial loss from his employment contract (up to about $2000) or give him 1-dollar.

    larger amounts were not an option.  
    and the trial is over.

    i suppose theoretically, Mueller could still sue 13 Management but considering that he already has a judgement against him for sexual assault and battery, i cant imagine that being realistic.
