"El Chapo" Seeks New Trial for Juror Misconduct

Joaquin "El Chapo" Guzman-Loera has filed a motion for an evidentiary hearing on the issue of whether flagrant and admitted juror misconduct during the trial warrants a new trial.

I wrote this long post on the juror misconduct when it was first disclosed.

The 26 page motion is available here. It was written by attorneys Marc Frenich and Jeffrey Lichtman (and very well done in my opinion).

I doubt this judge will allow the defense to question the jurors, but hopefully he'll at least agree to question them himself and ask written questions proposed by both sides.

    issue if the judge bars interviewing the jurors and filing juror declarations in support of a motion for new trial.

    but I had a similar issue come up in a high-profile case I was co-counsel in about ten years ago, and it got swept under the rug with various forms of judicial trickery and double-talk.

    plaintiff filed a motion for new trial asserting jury misconduct. Trial court denied.  Court of appeal affirmed. But issue was what one juror allegedly told the other jurors. Not outside sources.

    After this, I wonder what happens to Ema. She was the real star of this trial. The media photographed her every move. I think she will start her own fashion business and become an icon in her own right. She just opened her own instagram account (all those others were fakes) and almost every account she follows is a designer or fashion celebrity. Maybe she'll start her own line of clothing or shoes. Maybe she'll just license her name. Maybe she'll be a guest on a reality show and then get her own. Maybe she'll host a news or fashion show on Telemundo. The possibilities are endless.
