Tuesday Open Thread

Our last open thread is full, time for a new one.

The trial of police officer Derek Chauvin is winding down. Judging from the reporting, it seems like the defense is going to have a hard time selling that George Floyd died of drugs and heart problems given the multiple experts called by the prosecution. The Judge expects the jury to get the case Monday, and they will be sequestered.

Nelson is presenting two key arguments. He says that whatever actions Chauvin took were reasonable and followed his training as a police officer, and that in any case those actions are not what killed Floyd.

“You will learn that Derek Chauvin did exactly what he had been trained to do over the course of his 19-year career. The use of force is not attractive, but it is a necessary component of policing,” he told the jury.

Donald Trump (anyone remember him?) is changing the name of his brand . His assets will now be named "45" and Trump's name will be removed.

His PAC can be accessed at SaveAmerica45.com. His White House's old tweets can be found at @WhiteHouse45. ...Trump's new website, 45Office.com, was created Jan. 12, less than a week after Trump supporters rioted at the Capitol to try to stop the counting of electoral votes in President Joe Biden's victory, according to internet records.

Trump has no intention of running for President again. He's trying to set himself up as the godfather of some new kind of party that will jump to get his children elected to public office. He's always been intent on starting a new TV network and the number 45 would be a good fit in for a brand name. I'd bet Jared had a hand in this. I hope everyone starts buying domains with "45" in them so Trump doesn't get them all. I did my part and bought "45VoteLeft", "45TalkLeft", and 45 TurnLeft". (I don't put it past him to lure in viewers and radio listeners with a false name and then proselytize to them). I also bought "45Crimes.com" and "45Crime.co" in case we need to remind people in 2 years of all the awful things he did to America and its standing in the world, while his children applauded him, and they all plotted to become a Dynasty. They're nothing. Now that I think of it, I should have also bought "45andCloudySkies" with the tagline "Today and Every Day".

In other news, I'm sorry to see Ecuador just elected a right wing ex banker as President, rejecting the leftist 36 year old candidate. Ecuador has suffered economically a lot since COVID and is in huge debt to the Chinese. I think I'm going to remove it from my list of countries to possibly move to. Medellin, Panama, Costa Rica and several places in Mexico seem like better fits.

Why move? I don't think the U.S. will recover from COVID as fast as other countries because on the one hand, we have too many idiots who won't take the vaccine and won't wear masks and don't give a hoot about anyone but themselves and on the other, are our politicians who are recklessly opening up too soon again. I believe we're going to be yoyo-ing back and forth from high to tolerable levels but not reach "herd immunity " until mid 2022 to 2023 and by then, who knows what other super-spreader virus will land among us?

This is an open thread, all topics welcome.

Austin is there to prevent the Joint Chiefs from going rogue....  someone is deliberately trying to start weird rumor internal fights.  The American Enterprise Institute is cite in the Politico story. And someone said that Lloyd Austin is still too much of an outsider and Biden's staffers weren't.  OMFG! Trump gutted the Pentagon. There is no way Lloyd Austin an outsider walking around that skeleton.

At the Pentagon are beginning to melt down. And rightfully so. The absolute most disgusting (someone once called them deplorables) are in highest GS slots. Sexual harassment and assault has been rampant, at the Pentagon, during Trump. And those who lead and participated are terrified they are going to be exposed. And they are.

I can't believe what some folks thought they would get away with, and I can't believe the initial CG response when he was told that subordinates were going to expose this stuff. He warned these subordinates they would create a lot of chaos.

    Have you seen The Nevers?

"The Nevers," Joss Whedon's steampunk brainchild and HBO's latest original series, drew over 1.4 million viewers across linear telecasts and digital during its premiere on Sunday night. The show scored the best debut for a new original series on HBO Max and surpassed viewership for other popular shows on the streamer, including Misha Green's horror drama "Lovecraft Country" and David E. Kelley's psychological thriller "The Undoing." This preliminary number will likely increase significantly as viewing across HBO's platforms and additional telecasts are factored in.

Per the logline, the fantastical, sci-fi period drama set in Victorian London takes place after the supernatural events of August 1896, in which certain people -- mostly women -- are granted extraordinarily abnormal abilities, from the wondrous to the disturbing. But, no matter their particular "turns" (aka powers), all who belong to this new underclass of "The Touched" are in grave danger. It all falls to mysterious, quick-fisted widow Amalia True (Laura Donnelly) and brilliant young inventor Penance Adair (Ann Skelly) to protect and shelter these gifted "orphans." To do so, they will have to face the brutal forces determined to annihilate their kind and protect those who are like them

    Back to the other thing

"As Biden weighed a full exit from the country this spring, top military leaders advocated for keeping a small U.S. presence on the ground made up primarily of special operations forces and paramilitary advisers, arguing that a force of a few thousand troops was needed to keep the Taliban in check and prevent Afghanistan from once again becoming a haven for terrorists, according to nine former and current U.S. officials familiar with the discussions."

"But in the end, Biden and his top national security deputies did what no previous president has done successfully -- they overrode the brass. ... [It] is Secretary of State Antony Blinken and national security adviser Jake Sullivan who are truly `running the Pentagon,' according to two former officials familiar with the discussions."

it appears that the generals got their input but not their way.  It is not as if the generals were given a  short shrift.  For 20 years we have bobbed from objective to objective, each to be successful only with a few thousand more troops.

The Secretary of State and National Security Advisor are not unaware of the military's concerns but seem to have balanced risks in their arguments for ending the military presence as it stands. President Biden used an inclusive and studied decision-making process that yielded the most viable pathway forward.  Now, it will be necessary to admit many Afghans to the US---those, and their families, who worked with the US as critical support, such as intelligence sources and interpreters.

by Militarytracy on Thu Apr 15, 2021 at 11:52:19 AM EST
Has come out on the record questioning Biden about this decision. There is a subtle questioning of Biden's authority that seems designed to draw a response from POTUS. I think Milley is looking for a way out now. Because all of the sexual harassment and assault going on inside the very Pentagon these past four years is going to slam into him.

And they held up Mrs. General Richardsons promotion announcement because they feared Trump would deny it to her. There are two General Richardsons. And they are married to each other. So some women in the military got protected from Trump's misogyny and some didn't. If you were a General you were protected.

This is going to go down like bloody hell when it starts.

And Mattis and Kelly and everyone else in the Trump Generals Band, a theme I could detect did surface. There was an idea or maybe a guiding principle that those who could magically serve a loser like Trump and support each other in doing so seemed to coalesce around, and that was that Obama people were making the military soft. They were taking the military out of the military. They believed the military was suffering from it also.

Of course Mrs. Richardson got a different sort of rough and tumble military Trump experience from the other girls.

    Testifying Thursday (5.00 / 1) (#7)
by CaptHowdy on Tue Apr 13, 2021 at 08:06:42 PM EST
A new report by the Capitol Police's internal watchdog found that department leaders overlooked key intelligence in the run-up to the riot on Jan. 6, including a warning that "Congress itself is the target," and barred the force's riot response unit from using its most powerful crowd-control measures.

The 104-page document, entitled "Review of the Events Surrounding the Jan. 6, 2021, Takeover of the U.S. Capitol," is the most searing portrait yet of the lapses and miscalculations around the most violent attack on the Capitol in two centuries. It adds significant new detail not unearthed in congressional hearings and is likely to inform a coming overhaul of the agency promised by lawmakers.

Michael A. Bolton, the Capitol Police's inspector general, classified the report as "law enforcement sensitive" and has not released it to the public. But The New York Times reviewed a copy before his testimony to the House Administration Committee, scheduled for Thursday.

    Here are the highlights.

by Peter G on Thu Apr 15, 2021 at 09:37:00 PM EST
getting at, is that the defense put on a very good case from a technical point of view, probably better than the prosecutors' case, because it was more concise and incisive. Do the job, then stop. But the substance of the defense case, the content and persuasive quality, was lacking. So if the case is decided on the evidence (which cannot be assumed), it looks like the State should get their conviction. If there are a couple of jurors with doubts, or who are just flat out unwilling to call a cop a murderer, that might lead to a "compromise" conviction on less than the most serious charge, rather than a hung jury or acquittal.

it seemed to me what the prosecution was trying to do, maybe what they saw as the most important thing to do, was humanize Mr Floyd.   All the emotional testimony that it started with.  And then to try to destroy every excuse they would make with gobs of expert testimony.  I think in some past trials of cops the humanity of the victim is kind of overlooked.

I think it's interesting the defense went to this carbon monoxide thing because it's apparently the one thing that might never have occurred to the prosecution, they thought it was to nutty for them to even try.   They tried to introduce testimony to refute it but the judge would not allow it saying any reference to it could mean a mistrial.

Like I said I have not been following this closely but that was my interpretation of what I've seen.

The defense was pretty clever, if I have all that right, to zero in on carbon monoxide.  As you say, it doesn't have to make sense.  And it one thing they never explained away.

All that said my feeling is it won't work and that Derek is going to lose.

    Maybe it's a hope.

Commission established, in a 9/11 style, to study and report on  the January 6 insurrection by Trump, supporters.  The DOJ indictment-by-indictment is telling a story and with some beginning to sing like a bird more will be learned.

However, Speaker Pelosi is apparently running into a brick wall trying to get cooperation from Republicans for a bipartisan effort, which is unsurprising because Republicans.  It will.be necessary, it seems clear, that Democrats move ahead on their own and impanel a blue ribbon commission of security, intelligence,  and other appropriate experts.  A special counsel would be another approach.

In any event, a study of the insurrection is essential.  It is unnerving that Eric's dad and other seditionists have not yet been held accountable, and even more unsettling that a comprehensive investigation into, and public reporting of, the attempted overturning of the presidential election and subversion of our democracy has not yet begun.

Canadian law recognizes three basic types of guns: non-restricted, restricted and prohibited. Firearms become more difficult to possess as the government's assessment of their danger increases. Handguns, for example, are restricted. Despite their designations, even restricted and prohibited firearms can be legally possessed and acquired."

"Licensing is extensive and mandatory. Without a license issued by the Royal Canadian Mounted Police, you can't legally possess or purchase a firearm in Canada. And without completing an authorized training course in firearm safety like this one, and then waiting a minimum of 28 business days for your application to be processed, you won't get a license."

None of really trusted the military with this stuff before Trump, but my understanding is it was a horrific 4 yrs for victims in the military. A rape that Delta forces was able to cover up seems to be the initial driver.

I think the Pentagon is waiting for all hell to break loose as victims realize now maybe they can talk and be safe, and obtain some relief and compassion and healing.

"Do Black people make up 75% of the Chicago population who are in possession of illegal amounts of weed or who are selling it illegally?"

The percentage of Black people who illegally possess, sell or consume pot is most certainly not greater than that of any other racial demographic in this country.

The legal cannabis market in the United States generated about $13.6 billion in sales in 2019 and yet, it presently accounts for only 30% of our country's total cannabis market at most. It's been further estimated that the underground cannabis industry presently generates revenues somewhere in the realm of $35 billion annually.

This stubborn notion that the black-market cannabis trade is somehow anchored or centered in our nation's economically challenged minority populations is logically (and logistically) preposterous. Follow the money. It will more than likely lead you to far more affluent communities, whose mostly white residents both have a lot more discretionary income, and tend to not be a significant focus of attention for law enforcement agencies.

you really missed the ball on this one, but let's not move the goalposts, shall we?

Among a number of other ways that you are changing your tune, you and the article were specifically talking about Chicago.

The article literally says that the wealthier/whiter areas of Chicago are served by legal pot shops, and many of the poorer/blacker Southside areas are not.

So how are the poorer/blacker areas getting their weed?

The article literally says that even in the poorer/blacker neighborhoods that have legal pot shops, many residents there still buy and sell pot illegally in order to evade taxes.

Tyrone F. Muhammad, executive director of Ex-Cons for Community and Social Change, and one of the black leaders quoted in the article, literally says that "Weed has been for decades a hustle for Black communities."

What does that mean to you?

Rep. Kelly Cassidy, a Chicago Democrat and one of the main sponsors of the bill that legalized recreational marijuana says that it's important to reduce the illegal pot market because it has "street-level components that are driving violence"

Chicago is one of the most violent cities in the country. The majority of the violence is in the poorer/blacker southside neighborhoods.

The stubborn notion that it is wrong for the police to go to where the violence is, is preposterous.

    Parent

Per the ACLU, while Black Americans and White Americans use marijuana at similar rates, Black people are nearly four times more likely to be arrested for it. Further, such disparities continue to exist even in states where weed has been decriminalized. (In New York City, people of color accounted for 94% of all arrests for marijuana possession in 2020.) There are consequences to this racial disparity, because criminal convictions for drug possession then impact an individual's access to employment and housing.

If you're defending the current system, then you're part of the problem.

I'm saying that the areas of Chicago that have a lot of crime and violence and illegal street-level drug issues will attract a large police presence, and those police are who bust people for illegal drugs.

NYC is the same, btw, since you brought up NYC arrests for possession.

ftr, 408 of the 437 (total in 2020) NYC possession arrests were for criminal possession.

Guess which NYC street gangs are highly involved in large (criminal) amounts of weed, illegal drugs, violence, property crimes, etc? Guess what the ethnic makeup of the Bloods, MS 13, and Latin Kings typically are? Guess why the cops keep a pretty close eye on them?

Marijuana use is approximately double among men vs woman, but the 2020 NYC arrests were 96% male, 4% female.

Is this evidence that males are being deliberately targeted by police?

Thankfully the laws surrounding weed are rapidly changing across the country (look at NY State's sweeping legislation from just 3 weeks ago) however, like alcohol, there will always be laws governing it and some people will attempt to evade those laws.

She has a very active twitter and Facebook presence.  I can't figure out much about her politics.  She is currently (also) the County Coroner.  And elected office. She ran as a Democrat but it's a more complicated story than that.  And a good one.

I told her today she should run against Huckabee-Sanders.  She laughed but not in a that's ridiculous way.  She is probably the second richest family (Town and Country Supermarkets) in the state after the Waltons.

How is your state for retirement? (none / 0) (#105)
by Chuck0 on Wed Apr 21, 2021 at 08:18:31 PM EST
I may be looking for a place to land. Single floor homes are hard to find on PA. I really like my house, built in 1905. Very reasonable mortgage payment. Even if I tried to rent it would cost me double.. I owned a mobile home for my step daughter for a little awhile. But really don't want to go MH living. Too many rules.

I need to work a couple more years, but I can work from anywhere with reliable internet.

PA has some advantages. Retirement income not taxed by state. No sales tax on clothing. Casinos. Low cost to register vehicles. And my auto insurance is ridiculous how much it dropped.

I've ridden my motorcycle through a large part of AR. Had a sweetie around Sheridan that I rode up to see from Ft worth. Went a music festival in Helena.

by CaptHowdy on Wed Apr 21, 2021 at 08:39:53 PM EST
it's the reason I live here.  It's so cheap to live here.  I am able to live remarkably well on a limited income.  In my area particularly.  For example that top comment about the Fayetteville area.  A good friend recently moved from there because he could not afford it on retirement income and bought a house near me and never stops talking about how much cheaper it is.  Just from another part of AR,

The reason it's great for retirement is there is nothing to do here work wise.  Walmart or some other retail.  That's really it.  People who live near me and work usually drive at least an hour in some direction.

So it's cheap to live here and great if you do not need to work.

My property tax, due on oct is 338.00. That's after something called "the homestead exemption".  Seriously.  And my little town has a special charge for services that make taxes here, in this little township, more expensive than the surrounding area.  Locally it's know for "high taxes".  I call it the whitectrash tax.  It keeps them out.

I've mentioned before we here for what ever reason have very good broadband.  Certainly not true everywhere in the state.  You could buy a house, a good house, move in ready for 60,000.  My friend just did that less than a year ago.  If you are willing to do some work way less.

But property here is going up. We have been hearing about it since the quarantine.  People from the surrounding urbanish  areas coming here because it's isolated and well served utility wise.  Many are working online.

Associated Press: "For any new leader, a lingering pandemic that has killed more than a half-million citizens would be plenty for a first 100 days. But it has been far from the sole preoccupation for the now 78-year-old Biden."

"The oldest person ever elected president is tugging the United States in many new directions at once, right down to its literal foundations -- the concrete of its neglected bridges -- as well as the racial inequities and partisan poisons tearing at the civil society. Add to that list: a call for dramatic action to combat climate change."

"He's doing it without the abrasive noise of the last president or the charisma of the last two. Biden's spontaneity, once a hallmark and sometimes a headache, is rarely seen. Some say he is a leader for this time: more action, less talk and something for the history books."

"The White House is preparing to unveil a roughly $1.8 trillion spending and tax plan this coming week that includes many of President Biden's campaign promises but also reflects the daunting challenges facing the administration as it tries to transform the U.S. economy," the Washington Post reports.

"The American Families Plan, set to be released ahead of the president's joint address to Congress on Wednesday, calls for devoting hundreds of billions of dollars to national child care, prekindergarten, paid family leave and tuition-free community college, among other domestic priorities. It will be at least partially funded by about a half-dozen tax hikes on high-income Americans and investors, proposed changes that are already provoking fierce opposition in Congress and on Wall Street."

fascist.    The Republican Party is no longer a political party interested in democracy or governing.  The January 6 insurrection was just warm-up practice.  The Big Lie is alive and well according to the DOJ and several judges, Arizona Republicans are recounting general election ballots in Maricopa County in a manner that would make Mussolini blush, DeSantis has signed a new Florida law making, essentially, protests Republicans do not like unlawful and providing  a way to provide a legal safe haven for  murder of protestors -by-car-ramming.  And, of course, the voter suppression laws like Georgia's proliferating in Republican-controlled states.

The Republican Party has no platform unless you consider hate, obstruction, dominionism, and authoritarianism.  It is not a valid negotiating partner in governance.  It needs to be recognized for what it is---a fascist ideology hell-bent on undermining  the liberal underpinnings of the US Constitution. And, they do not rule out violence to do so, as we know.

"The presidency is the most powerful position in the country, but it could accidentally wind up with a new perk: the ability to cast electoral votes. That's because, as a result of a constitutional quirk, the current push for D.C. statehood would leave a remnant federal district in which the White House might be the only permanent residence. It's one of the more bizarre features of the long-running fight to grant congressional representation to the 700,000 taxpaying residents of the District of Columbia..."

"There's no easy fix for such a scenario, because it would take a new constitutional amendment to undo the 23rd Amendment, which is far more difficult to pass than simple legislation."

"Far from a conventional post-White House retirement, Trump's first 100 days out of office illustrate a man who has preferred plotting the next chapter of his political career to planning his presidential library, recruiting MAGA-aligned Republican primary challengers to writing a post-presidential memoir. Whereas his predecessors disengaged from politics for months after leaving office, Trump has turned the same political warfare that defined his presidency into a full-time retirement hobby as he weighs a full return to the spotlight with a potential comeback presidential bid in 2024."

"More than a dozen Trump aides, confidants and allies who spoke with CNN say the former President, who remains bitter about his defeat in the 2020 election, has nevertheless come to enjoy his status as a GOP kingmaker, relishing his ability to disrupt races or elevate pro-Trump figures against dissenters inside the party. Others noted that he is yearning to return to the White House and claimed that his efforts to build a post-presidential political machine are principally aimed at supporting that goal."

all these birds like Rudy, Victoria Toensing and Joey diGenova, Sidney Powell and Lin Wood made some sort of suicide pact to go down in flames at the end of their careers.

Could there possibly be some biochemical or sunspot activity explanation for what's going on with these people?

Softly spoken , taking advantage of the special

    85% approve of the speech
    15 disapprove

78% were optimistic about America after hearing it

    CNN/SSRS

71% said it made them feel optimistic

73% said would move the country in the right direction

In these tribal times that's pretty impressive

it was bad enough to be career ending. Lucky for him he represents Sc. But he can join Lindsay as another laughing stock from the illustrious state of SC.

He did not even respond to what Biden said. It was just one of those white grievance speeches given by a black guy

Investigators Already Working with Giuliani's Associates

April 29, 2021 at 5:57 pm EDT By Taegan Goddard 19 Comments

"By the time federal investigators searched the Manhattan home of Rudy Giuliani on Wednesday, they had amassed a trove of evidence from his associates in Ukraine, focusing most intently on Giuliani's ties to Ukrainian oligarchs," Time reports.

"The witnesses, who spoke on condition of anonymity, described lengthy interviews with investigators in Europe, Manhattan and Washington, starting in the fall of 2019 and continuing through February. The calls and meetings with investigators grew more frequent and `intense' after Joe Biden's victory in last fall's presidential election."

"Two of the witnesses say they were working with Giuliani while cooperating with federal investigators."

The raid felt good.  How good will the indictment feel?

"Donald understands that Rudy will provide whatever information he has to the SDNY because Rudy has no interest in spending the golden years of his life in prison"

    M. Cohen, the former lawyer, earlier.

They played a FOX clip of Rudy saying if Trump ever threw him under the bus "he has insurance".

    I bet he probably does.

why Trumps first impeachment was worth doing even if we knew the republicans would never convict.

A lot of that testimony is probably going to help nail Rudy.

would suggest he is saying that if you take the 26 senators (52% of 100) who hail from the least populous states, and attribute to each of them 50% of the population of the state they represent (since each state gets two senators, regardless of population), then the sum of those numbers would be equal to 18% of the whole U.S. population.
