U.S. Soldier to Plead Guilty to Abuse

Javal Davis has agreed to plead guilty in his Iraqi prisoner abuse case. This is an about face because even after Sgt. Charles Graner's conviction, his lawyer said he planned to raise the "orders from above" defense for Davis.

Davis, 27, of Roselle, had been charged with conspiracy to maltreat detainees at the Abu Ghraib prison, dereliction of duty for failing to protect detainees from abuse, and maltreatment of detainees. Those charges will be dismissed, and Davis - who is not seen in any of the notorious photos from the prison - will plead guilty to simple assault and rendering false official statements...

Davis' jail exposure will be reduced from a possible 8 1/2 years to 1 1/2 years, but his lawyer is hoping to get him out without jail time and to keep him in the military.

    Why "prisoner abuse"? Isn't this prisoner "torture"? Must we adhere to the Bush dictionary? JC

    I believe the Nazis used the "just following orders" defense. Didn't work with them, won't work with this guy. It's actually a violation of the UCMJ to carry out an illegal order.

    Steve- Everday patsy........ I't's nice to see a member of the right, a self-described conservative patriot, who cares so little for the law, and the UCMJ. Funny, I always thought respect for the rule of law was the cornerstone of conservatism. At least that's what I was taught by my Eisenhower-Republican Father. I guess that gets tossed out as soon as it proves a little difficult, or gets in the way of some pet crusade. Gee, when someone on the left does that, I always hear the right decrying their "moral relativism". You can love your country like a child who believes it can do no wrong, or like an adult who wants it to be responsible. You are clearly part of the former group.

    Looks like Davis's lawyers plan worked to perfection to get him this kind of deal.
