Last Night in Little Rock Wins Terrorism Trial

Kudos to John Wesley Hall, who contributes to TalkLeft as Last Night in Little Rock. He's been silent here for a while, and here's why: He's been defending a man accused of providing material support to terrorists in Arkansas. Yesterday the jury returned a verdict of not guilty on the charge.

Arwah Jaber, a naturalized U.S. citizen born in the West Bank town of Yamoun, was acquitted Monday of providing material support to the recognized terrorist organization, Palestinian Islamic Jihad, but he was convicted on five lesser charges related to immigration and credit card fraud.

Jaber plans to go back home and teach when his legal problems are over. He received his doctorate in chemistry from the University of Arkansas. He said he would like to stay and teach in Arkansas if allowed but realizes that may not be possible.

The Government has moved to revoke his citizenship. But LNIR made some great arguments and the Court has taken it under advisement and allowed Jaber to remain on bond.

John Wesley Hall, Jr., Jaber's attorney, questioned whether the court has the jurisdiction to order Jaber to be detained for the federal Immigration and Customs Enforcement agency.

Hall also asked the court if the statute mentioned in the revocation request meant conviction as when the jury renders a verdict or after sentencing. Hall asked the court if Jaber's naturalization is revoked and then the defense wins an appeal, would Jaber's naturalization be reinstated.

Here's the paper's description of the case:

Jaber and his wife, Dawn, were pulled out of line by FBI agents at the Northwest Regional Airport on June 14, 2005 on their way to Palestine. Jaber told his doctoral professor and others at the university that he was going to Palestine to "fight for freedom, peace and justice." Jaber testified last week he was frustrated with a professor over delays in graduating and made the statements in an effort to sway the teacher into approving his degree. He said he didn't mean any of it and recanted the statements under questioning by FBI agents.

    In these fascist times what was Jaber thinking??? Does anyone wonder what would have happened if Jaber was an Israeli and said that he was going to Israel to "fight for freedom, peace and justice." Most likely he would have gotten a free plane ticket and a Presidential medal. It is hard to keep straight whether Israel is the 51st state or whether we are just a colony of Israel.

    Hmm Credit Card Fraud, I'm guessing this was sending money to Palestine via groups we've designated as terrorist organizations? I take it he wasn't stealing credit cards, or Id theft.

    Matt, A little casual Googling says the credit card fraud was pretty mundane stuff. He paid for his apartment, for instance, with an illegally-obtained card. Seems like the only evidence of a terrorist connection is his statement to his professor before leaving. A dumb thing to say, but not such great evidence. Good work, LNiLR.

    "fight for freedom, peace and justice." Wow, the terrorists have won if folks get arrested for that. Isn't that what our soldiers are doing in iraq? Next they'll arrest Superman.

    BTW, great job John Wesley Hall, it's a good thing your client didn't like paintball. narius, they alleged terrorism charges against him. If you had committed the same 'credit card' offenses, (he paid the bills, he just used a different name to apply for it) it would be a misdemeanor and you'd be OR'd and probably just pay restitution and a fine. He's a citizen, just like you, only he earned it, you were just born with it.

    TL, no offense to you, but my Dad dropped that appelation after Watergate ... he chose 'a lawyer for the defense in criminal cases';-)

    In this modern climate of "kill all brown people and let god sort them out", either the defense must have presented an outstanding case, or the prosecution had nothing but a brown face and a non indo-european name to go on.

    I know this may come as a surprise to some of you, but the man is a PhD chemist (as am I). It's not unusual for a chemist, a naturally curious type of being, to hear a name in the news (e.g., triacetone triperoxide) and to look up the chemistry of that compound. Or to have a PP presentation about making explosives. Ferchrissakes, it's what we do. Perhaps he was preparing a lecture for a class in forensics. Or a hundred other reasons. I wrote a chapter on chemical warfare agents. Heaven forbid that the FBI look at my computer and see all those references to ricin and mustard gas and saxitoxin. Kind of smacks of the thought police. The presence of a reference or a PP presentation on a computer doesn't make someone a terrorist. In fact, I'd be willing to bet that real terrorists don't do many PowerPoint presentations.

    ytterby, So long as you don't declare your intentions to fight in a jihad against the infidels, I'd say you are on the safe side. Kashin, If Osama were under my bed, the enemies of Islamofascism would be rejoicing this morn. Johnny, Thanks for the insights. Fascinating.

    I'm sorry demo, were you attempting to be sardonic? I really feel bad for you, he won. And in this day and age of gitmo, lindh, et al... unless the jury were all AQ members in good stead, he was not a terrorist.

    I'm so grateful there are people like Mr. Hall around to prevent Americans of Arab descent from getting railroaded in the current climate.

    He didn't say he was going to fight in a jiahad against the infidels, he said he was going to Palestine to "fight for freedom, peace and justice." Isn't that what people like Martin Luther King and Nelson Mandela and any number of other crusaders for human rights say? You don't have to be a suicide bomber to "fight for freedom, peace and justice."

    I would say you can't be a suicide bomber (or a bomber of any kind) if you are fighting for freedom, peace and justice. That fight, when done correctly and truthfully, is done unarmed like King and Ghandi.
