Trump Loses Another Court Battle on Release of Taxes

Donald Trump loses once again, this time in the Second Circuit appeals court which upheld the refusal of the trail court to quash subpoenas in New York state investigation of Trump wronging.

The decision is Trump v. Cyrusr, 2020 U.S. App. LEXIS 31772 and is available free here.

    going to keep losing. It's just a matter of when. I wonder if there is another reason he can come up with to restart this in the courts again. Trump has to be a literal gravy train for lawyers. Well, that is if he actually pays them.

    by the campaign, illegally (IMHO) misappropriating contributions from his supporters for a personal rather than a political purpose, in violation of the rarely-enforced federal election law.

    in the earlier thread. Standard post-decision procedures in the federal appeals courts would not result in this being resolved before Election Day. And it is not heading for a public disclosure of the tax returns at this time anyway; the subpoena is to a grand jury, which is secret until and unless charges are brought. As Tr*mp's lawyers are playing for time and deliberately maximizing delay, the court will have to take preemptive action to cause things to speed up. And if the lawyers then pretend to try another appeal to the Supreme Court, there are no rules requiring that to be resolved quickly.

    This is the first time they heard this I guess.  Will it still be considered expedited?

    it to be expedited. Either on its own initiative, or at the request of a party. (So far, to my surprise and confusion, the NYC DA's office has acquiesced at every stage in a series of stays that have prevented them from implementing the rulings that have gone consistently in their favor.) And "expedited" by court standards is still nothing like "prompt" or "speedy" in the real world.

    I thought there was some "legal protocol" the NYC DA's office was following which was causing the delay in getting the returns.

    a winning party ordinarily has the right to act in accordance with their victory, even while the other side appeals, unless a court orders otherwise (called a "stay"). Some state courts have the opposite rule (sometimes called an "automatic supersedeas"), but this litigation is in federal court. Hence, my puzzlement at the NYC DA's actions so far.
