Colorado's "Make My Day" Law

The Denver Post has an article today about Colorado's "Make My Day" law that allows homeowners to use deadly force against an intruder in their home.

Introduced in 1985 as the Homeowner Protection Act, "make my day" gives Colorado residents the right to shoot and kill an intruder if they believe the person intends to commit a crime and use physical force, "no matter how slight." That extraordinary right stops at the door. Front porches and backyards don't count.

In other words, to shoot and kill an intruder in the home, a homeowner need only reasonably believe a trespassing person might use any measure of physical force on any occupant of the home. The law is explained here.

Outside the home:

... in Colorado, as in Florida, fists can be deemed deadly weapons that justify gun use outside the home.

CO Concealed Weapons Permits Soar, Recall Election Set for 2 Dems

As Democrats in Colorado pushed through three new gun control laws in March, 2013, with virtually no support from Republicans, applications for concealed weapons permits were soaring.

In the first half of 2013, the Denver Post reports the numbers rose dramatically, from 16, 886 to 31, 518:

From January to June, 31,518 background checks were processed for concealed-carry permits by the Colorado Bureau of Investigation, according to bureau data. For the same period last year, there were only 16,886 processed

Eric Holder on Gun Control

Eric Holder has always been a strong supporter of gun control. From his Weekly Briefing on March 20, 2000 (available on Lexis.com):

I want to add my voice to those who are calling on Congress to finally -- to finally -- pass these very common-sense gun measures.

First, to require child safety locks for all handguns that are sold. Second, to ban violent juveniles from ever having the ability to own guns.

Third, to pass the president's handgun licensing proposal, which requires safety certification for all handgun purchasers.

Gun Sales Up Since Election

The LA Times reports gun sales are up in the wake of last week's election. The Denver Post reported last week the election has spurred a rush on gun sales in Colorado due to fears an Obama Adminstration will restrict Second Amendment gun rights. The Kansas City Star recently reported gun sales are up all over the country since October, when Obama seemed poised to win the election. Sales are also up in Iowa.

Supreme Court: Second Amendment Conveys Individual Right to Bear Arms

Update: D.C. v. Heller has been released. The Supreme Court, in an opinion by Justice Anton Scalia, has affirmed that the D.C. handgun ban is unconstitutional:

The Second Amendment protects an individual right to possess a firearm unconnected with service in a militia, and to use that arm for traditional lawful purposes, such as self-defense within the home.

No Decision Today in D.C. Handgun Case

Bump and Update: The Court did not issue an opinion today in D.C. v. Heller. Scotus Blog says the Court announced all remaining decisions will released tomorrow at 10:00 am ET.

Awaiting the Supreme Court's Second Amendment Decision

Will today be the day the Supreme Court issues its long-awaited opinion in D.C. v. Heller, deciding the constitutionality of D.C.'s handgun ban and settling the question of whether the Second Amendment conveys an individual right to bear arms?

Several court watchers think so. Concurring Opinions believes it will be authored by Justice Anton Scalia, who has yet to write an opinion in the March sitting cases. Heller is also the only case remaining among the March sitting cases. [Hat tip Instapundit.][More...]

Kentucky Hosts NRA Convention This Weekend, McCain to Speak

The NRA is holding its annual meeting in Louisville, KY this weekend. John McCain will be speaking. He has tended to campaign against Obama rather than Hillary. There are Democrats who belong to the NRA. The NRA backs Democrats who support their issue. If McCain attacks Obama on gun rights, will he cost him any primary votes?

Here's who the NRA backed in 2006:

The NRA has returned the favor. In this year's election, the group is backing Nebraska Sen. Ben Nelson, Oklahoma Rep. Dan Boren, Tennessee Rep. John Tanner and West Virginia Rep. Alan Mollohan, among others. In gubernatorial races, the NRA has endorsed Democrats in Oklahoma, Tennessee and Wyoming, and Bill Richardson, the former Clinton energy secretary and cabinet member, in New Mexico.

"The NRA is not an affiliate of the Republican party," said Grover Norquist, a conservative activist who also is an NRA board member. "They endorse incumbent Democrats who have voted with them on their issue. They understand that the first time they oppose a Democrat who has been supportive of the gun issue, they lose that D vote."
